Question : What is a Person Resident in India?
Answer : "Person Resident in India" means-
(I) a person residing in India for more than one hundred and eighty-two days during the course of the preceding financial year
(ii) any person or body corporate registered or incorporated in India,
(iii) an office, branch or agency in India owned or controlled by a person resident outside India,
(iv) an office, branch or agency outside India owned or controlled by a person resident in India
Question : What is Capital Account Transaction?
Answer : "Capital Account Transaction" means a transaction which alters the assets or liabilities, including contingent liabilities, outside India of persons resident in India or assets or liabilities in India of persons resident outside India, and includes transactions referred to in sub -section (3) of section 6 i.e. transfer of share, deposits between PRI and PROI, transfer of immovable property export, import or holding of currency or currency notes; borrowing; lending .
Question : What is current Account transaction?
Answer : Transactions other than Capital account transactions are current account transactions.
Question : What is Overseas Direct Investment (ODI)?
Answer : "Overseas Direct Invest means investments, either under the Automatic Route or the Approval Route, by way of:
(a) Contribution to the capital or subscription to the Memorandum of a foreign entity, or
(b) purchase of existing shares of a foreign entity either by market purchase or private placement or through stock exchange, signifying a long-term interesting the foreign entity (JVorWOS)
However, it does not include Portfolio investment.
Question : What is External Commercial Borrowing?
Answer : ECB’s are commercial loans raised by eligible resident entities from recognized non resident entities and should conform to parameters such as minimum maturity, permitted and non-permitted end-uses, maximum all-in-cost ceiling, etc.
